Embed-Friendly theme - hide side panel button

I have made a new theme for my board based on "Embed-Friendlyversion 1.0by Mark O'Sullivan" using V 2.0.12 and got everything looking how i liked on my test install.
ive now ported the theme over to my live forum (runnin the latest build) to deploy it and to my surprise the 'hide side panel' button isnt showing up in the dashboard so i cant toggle it off, and as such my theme is looking broken.
what gives? is it a problem with the foum software? the theme files are identical in both versions as far as i know.
