New reply doesn't show up in new topic

When someone creates new topic and there is no replies yet, you reply will not show up immediately.
It is caused by JavaScript from custom.js in gopi theme
e("ul").not(":has(li)").remove() - this code is to blame, as it removes empty list from comments conatainer. Commenting or removing this code solves the issue.
