There has to be some level of courtesy though, The colour scheme, CSS, layout, etc, is all the intellectual property of Shaun Inman, and aside the probably legal implications, it's poor form to go and take something lock stock without permission, even if it is just a bunch of hex codes.

at least there is no copyright on colors and arrangements of tables ... its also legal to reproduce code. but not to distribute a (1:1) code of someone elses work.
the problem is at least ... mint is not a classical graphic design work, its a very minimal arrangement of css tables and a colorsheme (and those 2 "basic components" are available and free 4 all) .
you could also say ... mark o'sullivan ripped the basic idea of a forum
I would ask, but thats just being courteous. He should agree to letting you use it/give it away, which would also be courteous. Its just something nice to do, because like everyone said its just layouts and colors.
But, If you do ask, and he does say no, he is an ass and id toss it out anyway. Isn't imitation a form of flattery? I would think so. If someone liked my design enough to do this and asked I would be grateful and happy. Not to mention it would most likely open up Mint to a lot of new prospective users (buyers). Which would be good for him.

I'm not going to release the Mint style to the public. However, you can just rip the Mint CSS files from the official website as this theme uses the same (x)HTML tags...
